Please read these Terms of Service carefully before using the QuickGig platform. By creating an account or using any part of our services you agree to be bound by these Terms. If you do not agree, do not use QuickGig.

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and QuickGig Pty Ltd (ACN XXX XXX XXX) (“QuickGig”, “we”, “us”, or “our”), a company incorporated in New South Wales, Australia.

By accessing or using the QuickGig website, mobile application, or any related services (collectively, the “Platform”), you confirm that:

  • You are at least 18 years of age;
  • You have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or policies published on the Platform;
  • You have the legal capacity and authority to enter into this agreement (and, if acting on behalf of a business entity, the authority to bind that entity).

If you are a venue operating in New Zealand, references to Australian law also apply to equivalent New Zealand legislation where specified in these Terms.

2. Platform Description

QuickGig operates an online two-sided marketplace that connects hospitality venues (“Venues”) seeking casual staff with independent contractors (“Workers”) available to work shifts. QuickGig is a technology platform provider — we are not an employer, staffing agency, or labour hire business.

QuickGig is not a party to the engagement between a Venue and a Worker. Any contract for services is formed directly between the Venue and the Worker when a shift is confirmed. QuickGig provides the technology, payment infrastructure, and matching tools to facilitate that engagement.

The Platform uses Claude AI (developed by Anthropic PBC) to score and match Workers to Shifts and to rank applicants for Venues. This AI-powered matching is a tool to assist decision-making; the final hiring decision rests with the Venue, and the final decision to accept a shift rests with the Worker.

QuickGig currently operates in Australia and New Zealand. All monetary amounts are displayed and processed in Australian Dollars (AUD) for Australian shifts and New Zealand Dollars (NZD) for New Zealand shifts unless otherwise stated.

3. Accounts and Registration

To use the Platform you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@quickgig.com.au if you suspect any unauthorised access to your account.

QuickGig reserves the right to suspend or terminate any account that provides false or misleading information, violates these Terms, or engages in activity that may harm the Platform or its users.

Each individual or business entity may hold only one account per account type (Worker or Venue). Creating multiple accounts to circumvent suspensions or other restrictions is strictly prohibited.

4. Worker Terms

4.1 Independent Contractor Status

Workers using the QuickGig Platform are independent contractors, not employees of QuickGig or the Venues they work for through the Platform, unless a separate written employment agreement expressly provides otherwise. Nothing in these Terms creates an employment relationship, partnership, joint venture, agency, franchise, or sales representative relationship between you and QuickGig.

As an independent contractor, you are responsible for:

  • Registering and maintaining a valid Australian Business Number (ABN) (Australia) or Inland Revenue Department (IRD) number (New Zealand) and providing accurate tax information on the Platform;
  • Complying with all applicable tax obligations, including goods and services tax (GST/GST NZ) and income tax reporting;
  • Obtaining and maintaining any required professional insurances, including public liability insurance where relevant;
  • Your own superannuation contributions (Australia) or KiwiSaver (New Zealand).

Workers acknowledge that Australian Fair Work Act 2009 employee entitlements (including minimum wage, leave, and unfair dismissal protections) and New Zealand Employment Relations Act 2000 employee entitlements do not apply to independent contractor engagements facilitated through the Platform. If you believe your engagement has characteristics of employment, you should seek independent legal advice.

4.2 Certification Requirements

Certain shift roles require legally mandated or venue-specific certifications. You must hold a current and valid certification before accepting shifts that require them. These may include, without limitation:

  • RSA (Responsible Service of Alcohol) — required for any role involving the service of alcohol in Australia. Requirements vary by state and territory.
  • LCQ (Licence Controller Qualification) — required for managing or supervising licensed premises in New Zealand.
  • Food safety handler certificates where required by the shift role or venue.
  • Any other certification specified in a shift listing.

You must upload valid copies of all relevant certifications to your profile. QuickGig may verify certifications and may suspend your account if certifications are found to be expired, invalid, or fraudulent. Accepting a shift for which you do not hold a required certification may also expose you to personal legal liability.

4.3 Reliability Obligations

Reliable attendance is fundamental to the QuickGig marketplace. When you confirm a shift, you make a commitment to the Venue. You must:

  • Arrive on time and prepared to work for the full duration of the confirmed shift;
  • Notify the Venue and update the Platform promptly if you will be late;
  • Cancel a confirmed shift at least 24 hours before the shift start time if you are unable to attend.

Cancellations made less than 24 hours before a shift start time are recorded as “late cancellations”. Failure to attend a confirmed shift without cancellation is recorded as a “no-show”.

4.4 Auto-Suspension Policy

To protect Venues and maintain the quality of the marketplace, the following automated suspension triggers apply:

  • 2 no-shows within any rolling 30-day period will result in immediate automatic suspension of your Worker account.
  • 3 late cancellations within any rolling 30-day period will result in immediate automatic suspension of your Worker account.

A suspended account cannot accept new shifts. You will receive an email notification upon suspension with information about the review process. To appeal a suspension, contact support@quickgig.com.au within 14 days. QuickGig will review the circumstances and, at its discretion, reinstate or permanently close the account.

4.5 Worker Payment Terms

Workers are paid the hourly rate displayed in the shift listing, inclusive of any applicable penalty rates. Pay schedule options are determined by the Venue (Instant Pay or Fortnightly Pay) and are clearly displayed on every shift listing before application.

  • Instant Pay: Payment is initiated to your Stripe Connect account within approximately 4 hours of shift completion confirmation, subject to Stripe processing times.
  • Fortnightly Pay: Payments for completed shifts are batched and initiated on a fortnightly cycle.

Workers must connect a valid Stripe Connect account to receive payments. QuickGig is not responsible for delays caused by Stripe, your financial institution, or incorrect bank details provided by you.

QuickGig deducts its platform fee (see Section 6) from the gross shift value prior to disbursement. The net amount payable to you is the hourly rate multiplied by hours worked, less the platform fee.

5. Venue Terms

5.1 Wage Compliance Obligations

While Workers are independent contractors and the Fair Work Act 2009 minimum employment entitlements do not automatically apply to their engagements, Venues must ensure that the hourly rates offered on the Platform are fair, lawful, and consistent with any applicable industry norms. QuickGig automatically calculates penalty rate suggestions for weekends and public holidays based on relevant industry awards as a guide; however, Venues remain solely responsible for ensuring their posted rates are lawful.

For New Zealand Venues, rates must also comply with applicable New Zealand minimum wage legislation and the Employment Relations Act 2000 as applied to independent service contractors where relevant.

5.2 Payment Obligations and Auto-Charge Consent

Venues are required to have a valid payment method on file at all times. By using the Platform, you authorise QuickGig (via Stripe) to:

  • Instant Pay shifts: Place a pre-authorisation hold on your payment method at the time a shift is confirmed, and charge the full shift cost (worker pay + platform fee) promptly upon shift completion;
  • Weekly Billing shifts: Aggregate all completed shift costs during a billing week and automatically charge your nominated payment method on the scheduled billing date.

This auto-charge consent is a condition of using the Platform as a Venue. You may update your payment method at any time in your account settings, but a valid payment method must remain on file.

5.3 Account Suspension for Non-Payment

If a payment charge fails, QuickGig will notify you by email and retry the charge within 48 hours. If the second charge also fails:

  • Your ability to post new shifts will be suspended immediately;
  • Existing confirmed shifts may be cancelled at QuickGig's discretion;
  • The outstanding balance will remain due and payable, and QuickGig reserves the right to pursue debt recovery.

Venue accounts with outstanding balances older than 30 days may be permanently closed. QuickGig may charge interest on overdue amounts at the rate of 2% per month above the Reserve Bank of Australia cash rate (or Reserve Bank of New Zealand OCR for NZ entities).

5.4 Venue Conduct on Shift

Venues must treat Workers with dignity and respect. Venues agree not to:

  • Require Workers to perform tasks outside the agreed scope of the shift without appropriate additional compensation;
  • Direct, supervise, or control Workers in a manner that would constitute an employment relationship under applicable law;
  • Discriminate against Workers on the basis of any characteristic protected by law, including race, sex, age, disability, religion, or national origin;
  • Retain Workers beyond scheduled shift hours without agreement and payment.

6. Platform Fee

QuickGig charges a platform service fee of 15% (fifteen percent)of the gross shift value (total hours worked multiplied by the agreed hourly rate). This fee is charged to the Venue in addition to the Worker's pay; the Worker receives the agreed hourly rate in full (subject to deduction of any applicable taxes as set out in Section 4.5).

The platform fee is inclusive of all QuickGig service costs including AI-powered matching, payment processing facilitation, platform infrastructure, and customer support.

QuickGig reserves the right to amend the platform fee rate upon 30 days' written notice to Venue account holders. Changes to fees will not affect shifts already confirmed prior to the effective date of the change.

7. Payments and Stripe Connect

All payments on the Platform are processed by Stripe, Inc. and its affiliates (“Stripe”) via Stripe Connect. By using the Platform you also agree to Stripe's Connected Account Agreement and Privacy Policy.

Workers must complete Stripe's identity verification (KYC) process before receiving payments. Delays in completing this process may delay your first payout.

QuickGig holds shift funds in escrow via Stripe until shift completion is confirmed. In the event of a dispute about whether a shift was completed, QuickGig's determination (following the dispute resolution process in Section 13) will be final for the purpose of releasing escrowed funds.

QuickGig is not a bank and does not hold an Australian Financial Services Licence (AFSL) or New Zealand Financial Services Provider registration for the purpose of providing financial advice. Payment facilitation is provided as part of the technology service only.

8. Prohibited Conduct

You agree not to use the Platform to:

  • Post false, misleading, or fraudulent information, including fake certifications, fabricated work history, or misrepresented venue details;
  • Attempt to circumvent the Platform by arranging off-platform engagements with other users you discovered through QuickGig within 12 months of first contact on the Platform;
  • Harass, abuse, intimidate, discriminate against, or defame any other user of the Platform;
  • Scrape, data-mine, or otherwise extract data from the Platform for commercial purposes without written consent from QuickGig;
  • Interfere with or disrupt the Platform's infrastructure, including by uploading malicious code or conducting denial-of-service attacks;
  • Create accounts for the purpose of manipulation, including generating fraudulent reviews;
  • Use the Platform in any manner that violates applicable law, including anti-money laundering, sanctions, or counter-terrorism financing obligations;
  • Impersonate any person or entity.

Breach of this section may result in immediate account suspension or termination without notice, and QuickGig reserves the right to report such conduct to relevant authorities.

9. Intellectual Property

All intellectual property rights in the Platform, including its software, design, trademarks, logos, and content created by QuickGig, are owned by or licensed to QuickGig. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform solely for its intended purpose in accordance with these Terms.

By uploading content to the Platform (including profile photographs, certifications, reviews, and other materials), you grant QuickGig a non-exclusive, worldwide, royalty-free licence to use, store, display, and process that content for the purpose of operating and improving the Platform. You represent that you own or have the right to upload all content you submit.

You must not reproduce, modify, distribute, or create derivative works from any QuickGig-owned content without prior written permission.

10. Disclaimers

The Platform is provided on an “as is” and “as available” basis without any warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the extent permitted by law.

QuickGig does not warrant that:

  • The Platform will be uninterrupted, error-free, or free from viruses;
  • Any AI match scores or applicant rankings will be accurate, suitable, or free from bias — these are tools to assist decision-making only;
  • Any Worker will attend a confirmed shift, or any Venue will provide a safe and appropriate working environment;
  • Information provided by users (including certification details) is accurate.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) or the Consumer Guarantees Act 1993 (NZ).

11. Limitation of Liability

To the maximum extent permitted by applicable law, QuickGig's total aggregate liability to you for any and all claims arising out of or in connection with these Terms or your use of the Platform (whether in contract, tort including negligence, statute, or otherwise) is limited to the greater of:

  • AUD $500; or
  • The total fees paid by you (Venues) or received by you (Workers) through the Platform in the 3 months immediately preceding the event giving rise to the claim.

QuickGig is not liable for any:

  • Indirect, incidental, special, consequential, or punitive damages;
  • Loss of profits, revenue, goodwill, or anticipated savings;
  • Loss of data or business interruption;
  • Acts or omissions of Workers, Venues, Stripe, or any other third party.

Where legislation implies a guarantee or warranty that cannot be excluded but can be limited, QuickGig's liability is limited to, at its option, re-supplying the service or paying the cost of re-supplying the service.

12. Indemnification

You agree to indemnify, defend, and hold harmless QuickGig, its directors, officers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any content you submit to the Platform. This obligation survives termination of your account.

13. Dispute Resolution

Step 1 — Platform Support:In the first instance, disputes between Workers and Venues (including disputes about shift completion, payment, or conduct) should be submitted to QuickGig's support team at support@quickgig.com.au. QuickGig will endeavour to facilitate a resolution within 10 business days. For payment disputes, QuickGig's determination regarding the release of escrowed funds is final.

Step 2 — Mediation: If a dispute is not resolved through Platform Support, either party may request mediation through the Australian Disputes Centre (ADC) or a mutually agreed mediator. Costs of mediation will be shared equally unless otherwise agreed.

Step 3 — Litigation: Disputes that cannot be resolved through the above steps may be referred to the courts of New South Wales, Australia, subject to Section 14 (Governing Law).

Nothing in this section prevents either party from seeking urgent interlocutory or injunctive relief from a court of competent jurisdiction.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You and QuickGig each irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.

For Workers and Venues based in New Zealand, nothing in this clause limits your rights under New Zealand consumer protection legislation, including the Consumer Guarantees Act 1993 (NZ) and the Fair Trading Act 1986 (NZ), where those rights cannot be excluded or modified by contract.

15. Changes to These Terms

QuickGig reserves the right to modify these Terms at any time. We will provide at least 14 days' advance notice of material changes by:

  • Posting the revised Terms on this page with an updated “Last updated” date;
  • Sending a notification to the email address associated with your account.

Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must cease using the Platform and may close your account by contacting support.
